Claudio Aliaga of Miami Lakes Florida was charged by the U.S. Commodity Futures Trading Commission (CFTC) for operating a forex Ponzi scheme. Mr. Aliaga, owner of CMA Capital Management LLC, allegedly solicited over $4.5 million from more than 125 investors over the course of three years. Mr. Aliaga promised investors that he would put their monies in a pool that would later be used in the trade of foreign currency. However, in a classic Ponzi scheme, Mr. Aliaga kept clients funds for his personal expenses, giving funds from newer investors to older ones. To conceal the crime, Mr. Aliaga also created false account statements that reflected positive returns based on his supposed trading. In the court’s final judgment, Mr. Aliaga was ordered to pay $5.5 million in restitution and civil monetary fees.
The CFTC has filed many administrative proceedings actions against Florida-based Futures Commission Merchants (FCMs), Introducing Brokers (IBs), Commodity Pool Operators (CPOs), and Commodity Trading Advisors (CTAs) or filed Federal court actions against those industry members and others not registered with the agency for allegedly engaged in violation of the Commodity Exchange Act (CEA) through alleged market manipulation schemes or fraudulent cash and/or leveraged coin and/or bullion transactions.
