Gary Saitowitz of Marietta, Georgia submitted a Letter of Acceptance, Waiver and Consent (AWC) to the Financial Industry Regulatory Authority (FINRA) for several alleged violations in connection with the sale of non-traded real estate investment trusts (REITs). Formerly registered with Transamerica Financial Advisors Inc. (Transmerica), Mr. Saitowitz allegedly recommended four customers to invest an unsuitable amount of their assets in REITs. The FINRA investigation found that Mr. Saitowitz’s recommendations were unsuitable in light of his customers’ investment goals and risk tolerances. Without admitting or denying the FINRA findings, Mr. Saitowitz was assessed a deferred fine of $10,000, suspended from association with any FINRA member for 12 months and ordered to pay $11,455 in restitution to the customer.
